A 5-year-old Pennsylvania girl who told another girl she was going to shoot her with a pink Hello Kitty toy gun that blows soapy bubbles has been suspended from kindergarten. Her family has hired an attorney to fight the punishment, which initially was 10 days for issuing a 'terroristic threat.' But her punishment was reduced to two days after her mother met with school officials and had the incident dropped to 'threatening to harm another student,' which apparently carries a lesser punishment. "It's laughable," Robin Ficker, the girl's attorney told FoxNews.com. "This is a girl who had no idea about killing or what happened in Connecticut." He was referring to the recent shooting massacre at Sandy Hook Elementary School that claimed 26 lives. "What parent that you know would want their 5-year-old questioned about making terroristic threats without them in the room?" - Robin Ficker, attorneyFicker says Mount Carmel Area School District officials said the girl made the threat on Jan. 10 as she waited for a school bus with friends. A school official overheard the remark and searched the girl's backpack and did not find the Hello Kitty gun, he said. The next day, the girls involved were 'interrogated' by school officials, Ficker said. By the time the girl was done speaking to administrators about the incident, she was crying, he said. A teacher called out the girl in front of her class and told her police may get involved, he said. Ficker called the girl "the least terroristic person in Pennsylvania." "What parent that you know would want their 5-year-old questioned about making terroristic threats without them in the room?" Ficker asked.
School district solicitor Edward Greco tells pennlive.com officials are looking into the case. He said Friday school officials aren't at liberty to discuss disciplinary actions. Ficker said he has scheduled a meeting with a lawyer from the school board later this month to have the girl’s record expunged.

The boy, a fifth-grader at Douglas MacArthur Elementary School whose name is not being released, was charged as a juvenile with brandishing a weapon, police said. He was also suspended from school, and Alexandria City Public Schools Superintendent Morton Sherman said further action is being considered, including expulsion. On Monday, the boy showed the plastic gun to at least one other student during a bus ride home from the school. The 10-year-old did not point it at anyone or threaten to shoot it, but he neglected to mention that the weapon was fake, said Alexandria police spokeswoman Ashley Hildebrandt. School officials said they learned about the incident Monday evening and immediately started investigating. Alexandria police spoke to school administrators Tuesday morning before the boy got to school. When the boy arrived, authorities found the toy in his backpack. He was taken into custody, transported to a juvenile detention center for booking and then released to his parents, Hildebrandt said. "The safety of our students is always our first concern," Sherman said. "We appreciate the quick response and action by our police." The toy resembled a semi-automatic handgun, said police spokesman Jody Donaldson. It was silver and had a black handle. It also had a orange tip that went into the barrel, showing that no ammunition was coming out of it. In light of current events involving schools and guns, Donaldson said police "do have a heightened sensitivity to any rumor or concern" about a student possibly having a firearm. "Any time we get a call like this, we take it very seriously until we can determine the extent of the weapon -- if it's real or not -- and what the student intends to do with it," Donaldson said. But some people said police and school administrators overreacted. "A toy gun is no danger to anyone," said Liane Rozzell, executive director of Families & Allies of Virginia's Youth. "A 10-year-old is not a fully formed adult by any means. And that kind of situation should be dealt with outside the courts and the justice system." Robin Ficker, a Bethesda attorney who represented a 6-year-old Montgomery County student who was suspended last month for pointing his finger and saying "pow," said the schools have become terror-stricken. "That just shows a certain hysteria with the school administration," Ficker said Tuesday. "What is the point? On August 17, 1996, a flyer was distributed throughout the Danville Community High School(IN).
Upon being seen by the school officials, it was immediately confiscated and an immediate interrogation began of everyone who had one in their possession.
Altogether, there were about 200 copies floating around the school. Word got back that one David M. Schroeder and one Patrick W. Gillespi were responsible
for the creation and distribution of this piece of "filth"-James Disney, Ass. Principal, and we were summoned to the office. As soon as we walked
in to the head fascist's office, we were immediately told that no unsolicited material could be passed out among the students, and that since this particular
document had objectionable content, it was inappropriate for school.We completely denied any involvement and told them that it was about time that something was said about this apathetic school and society and also asked how
they figured that we had anything to do with it since we didn't have a single
copy of the flyer nor were we seen passing them out by anyone. Their response
was "Well, we heard from an unnamed student that you were in the Kroger's parking lot passing them out to other students." What exactly did this have to
do with the school? To this day, I still have no idea. I doubt I ever will, aside
from the fact that our "alternative dress and lifestyle" were under constant
scrutiny by both the principal and ass. principal, David and James
respectively. After being told that we, without any evidence, were responsible for this, we asked what exactly was this objectionable and
inappropriate material. Would any of you like to take a guess at what this was?
Mr. James Disney picked up a copy of the flyer that happened to be sitting on
his desk and pointed out two things... one caption that said "a subculture of
dreams and sex" and another that said "celebrate the rights of homosexuals."
What does that say for Danville schools?You can figure that one out. I know. I have been a victim of their tyranny and moral judgments for 4 years. So now,
against their every wish and hope, I present you with Newspeak.
To save my friends/co-conspirators from the wrath of school (institutional) administration, I am making this an e-zine. It will be posted bi-monthly starting
in mid-July. Hopefully, this will aid in the waking up of this country to the fascism, oppression, lies, prejudices, and terrorism that make this country/society the
blatant contradiction that it is.I am still an minor... until Dec. 8. I am not in high school anymore thanks to the
same fascism and bias of the same school system. I was expelled for excessive absences the first semester of last year (I missed too much of my first and
second period classes) and I was forced to withdraw within two weeks of returning the second semester. Reason being.... they found a pack of cigarettes in my locker. Upon finding them, they called my father in to the school and said that since I
had been absent once already this semester and I was tardy to class every so often, they were going to expel me unless he withdrew me from school. So I
had the ultimatum of my life thus far... graduate two years later than the rest
of my class or drop out and get my GED. I choose the latter, and now I have a
GED Honors Diploma, I take my ACT's in the fall, and I start college in
January.
I could rant and rave about the countless things that happened at that school to me and
my friends (suspensions because of clothing, jewelry, speeches, protests...etc.), it's not
very often you find someone with an open mind trying to do something about such apathy.
